Article 1 – Scope of Application
These Terms and Conditions of Sale (T&Cs) apply, without restriction or reservation, to all sales concluded by ST37 Sport et Technologie SAS with non-professional buyers (“Clients”) wishing to purchase the products offered for sale on the website.
Products concerned include: fencing equipment, weapons, clothing, shoes, blades, masks, gloves, scoring equipment, etc.
The Client is invited to consult the characteristics of each product (description, images, dimensions) available on the website before placing an order.
Product offers are valid while stocks last. These T&Cs are permanently accessible on the website and prevail over any other document.
Article 2 – Evidence of the Transaction
By checking the box provided for this purpose before validating the order, the Client accepts these T&Cs. Data recorded in the computer systems of ST37 constitutes proof of transactions carried out between the Parties.
Article 3 – Product Prices
Products are sold at the prices in force on the website at the time of the order, expressed in euros (excluding and including VAT).
Prices take into account any discounts granted.
Prices are firm during their validity period, but ST37 reserves the right to modify them outside of this period.
Handling, shipping, and delivery costs are additional and indicated prior to order validation. The total amount payable includes these costs.
Article 4 – Formation of the Contract
The Client selects products, adds them to the cart, enters required information, chooses the payment method, accepts these T&Cs, and proceeds with secure payment (bank card or transfer).
The sale is deemed concluded once full payment has been received.
ST37 reserves the right to cancel or refuse any order from a Client with a prior unpaid dispute.
Article 5 – Right of Withdrawal
In accordance with Article L221-18 of the French Consumer Code, the Client has 14 days from the date of order to exercise the right of withdrawal. Return costs are borne by the Client.
Products returned in their original condition, complete, and accompanied by the invoice, will be refunded or exchanged within 14 days of receipt.
This right does not apply to damaged, incomplete, or used products, nor to professional use or deliveries outside the relevant territories.
Article 6 – Delivery
Products are delivered to the address indicated by the Client when ordering. The delivery time is specified at the time of the order and confirmed by customer service. If not, delivery shall take place within a maximum of 30 days.
In the event of late delivery (excluding force majeure), the Client may send a formal notice (registered letter or email). If the product is not delivered within the additional period, the Client may cancel the order and will be refunded within 14 days.
The Client must check the product upon delivery and report any apparent defect or non-conformity within 48 hours, otherwise the product will be considered accepted.
For deliveries outside the European Union, the Client is considered the importer and is responsible for customs duties or taxes.
Article 7 – Transfer of Ownership & Liability
Ownership of products passes only upon full payment, regardless of delivery.
ST37 is not liable for delays due to force majeure or foreign regulations, nor for damage occurring after delivery. Responsibility for the goods passes to the carrier once shipment is made.
Article 8 – Legal Warranties
Products benefit from legal warranties of conformity (Articles L217-4 to L217-5 of the French Consumer Code) and hidden defects (Articles 1641 to 1648 of the French Civil Code).
The Client may invoke these warranties by contacting ST37 (by email or mail). If the defect is confirmed, the product will be repaired, replaced, or refunded within 14 days. Return costs are borne by the Client, except in justified cases where ST37 will cover them.
Warranties are excluded in cases of normal wear and tear, negligence, accident, force majeure, or improper use.
Article 9 – Liability
Products comply with French legislation and EU standards. ST37 cannot be held responsible for non-compliance with laws applicable in the country of delivery if it is outside the EU.
Photographs and illustrations are indicative only and not contractually binding.
Article 10 – Data Protection
Personal data collected is necessary for order processing and invoicing, in compliance with the French Data Protection Act and the GDPR. The Client has the right to access, modify, rectify, delete, and object, as set out in our Privacy Policy.
Article 11 – Disputes & Mediation
These T&Cs are governed by French law. In the event of a dispute, French courts have exclusive jurisdiction.
The Client may also use a free mediation service (ANM, ODR) if the dispute remains unresolved after contacting customer service.
Article 12 – Intellectual Property
All content on the site is the intellectual property of ST37 or its partners. Any reproduction or use without authorization is prohibited.
Article 13 – Updates
ST37 reserves the right to amend these T&Cs at any time. The applicable version is the one online at the time of the order. Clients are encouraged to review this page regularly.
